1. Acceptance of These Terms

These Terms of Service (“Terms”) are a binding agreement between you and Kickoff Advertising, LLC (“Brunch After,” “we,” “us,” or “our”). By creating an account or using the Brunch After app or services (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Brunch After. By using the Service, you represent that you are 18 or older, that you can form a binding contract, and that you are not barred from using the Service under applicable law.

3. Your Account

• You register using your phone number and a one-time verification code.
• You agree to provide accurate information and to keep it up to date.
• You are responsible for activity on your account and for keeping access to your phone number and device secure.
• You may not have more than one account or create an account for anyone else.

4. License to Use the Service

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.

5. Community Rules and User Conduct

You agree that you will not:

• Harass, threaten, bully, or harm other users.
• Post nude, sexually explicit, violent, hateful, or otherwise objectionable content.
• Impersonate anyone or misrepresent your identity, age, or affiliation.
• Solicit money, promote commercial activity, spam, or engage in scams.
• Use the Service for any illegal purpose or to facilitate illegal activity.
• Collect or misuse other users’ information, or share it without consent.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

Violating these rules may result in content removal, suspension, or permanent termination of your account.

6. User Content

You retain ownership of the content you submit (such as your profile, photos, and messages). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use that content solely to operate and provide the Service. You are responsible for the content you submit and represent that you have the rights to share it. We may remove content that violates these Terms.

7. Safety and Interactions with Other Users

Your safety matters, and you are responsible for your own interactions. Brunch After does not conduct criminal background checks or identity verification on users. We do not guarantee the conduct, identity, or intentions of any user. Use good judgment: meet in public places, tell someone where you are going, and do not share sensitive personal or financial information. You interact with other users at your own risk.

We provide tools to help you stay safe, including the ability to report and block other users. We encourage you to use them.

8. Moderation

We may, but are not obligated to, monitor or review content and conduct. We may remove content and suspend or terminate accounts that violate these Terms or that we believe may harm users or the Service. We aim to act on serious reports promptly.

9. Purchases and Subscriptions

The Service is currently free to use. If we introduce paid features in the future, the applicable prices and terms will be presented to you before purchase, and purchases made through the Google Play Store will be subject to Google’s terms.

10. Intellectual Property

The Service, including its name, logo, design, and software, is owned by us and protected by intellectual property laws. Except for your own content, nothing in these Terms grants you any right to our intellectual property.

11. Third-Party Services

The Service relies on third-party providers (such as Google, Twilio, Supabase, and Expo). We are not responsible for third-party services, and your use of them may be subject to their own terms.

12. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or for other lawful reasons. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitations of liability) will survive.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MATCH OR INTERACTION WILL MEET YOUR EXPECTATIONS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUNCH AFTER AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR FROM YOUR INTERACTIONS WITH OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR ONE HUNDRED U.S. DOLLARS ($100).

15. Indemnification

You agree to indemnify and hold harmless Brunch After from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [__], without regard to its conflict-of-laws rules.
